The Town of Durham Zoning Ordinance has strict occupancy limits on unrelated
tenant rental properties. A Single or Duplex Family Dwelling occupied only by
unrelated tenants is limited to no more than 3 maximum unrelated tenants; but
no more than 1 tenant for every 300 square feet of habitable floor area (this
area measurement excludes hallways, stairs, closets, basements, garages, storage,
etc.). In Multi Unit Dwellings (3 or more units) rental apartment properties,
the limit is 1.5 tenants per 300 square feet of habitable floor area. There
are also requirements for egress windows in each bedroom and smoke detectors
in each bedroom. If a property is found not to be in compliance with these
rules you may be forced to move out in the middle of the semester if your name
is not on the lease. Please be cautious about subletting and not having
your name on a lease. Just because there may be more than 3 in an apartment
or house now, that may not mean it has legal standing. Check it out before you
